1. Scope

These Terms and Conditions (“Terms”) apply to all use of our website and the 3D map platform provided by us. By accessing or using our website and services, you agree to be bound by these Terms.

2. Services Provided & Open-Source Stack

We provide a 3D visual mapping environment utilizing open-source rendering software frameworks and pipeline stacks (including MapLibre and Mapterhorn). The platform allows users to generate 3D map layouts. We reserve the right to modify, suspend, or discontinue parts of the service at any time without prior notice.

3. Data Sources, Accuracy & No Warranty

3.1 Third-Party Data: The geographic data, terrain layers, topographic styles, and basemaps displayed within the App are compiled from publicly available, open-source, and governmental data sources. The system incorporates data layers from independent third-party contributors, including:

– OpenStreetMap contributors (licensed under the Open Database License – ODbL)
– OpenTopoMap (licensed under CC-BY-SA)
– Satlas / Allen Institute for AI (licensed under CC-BY-4.0)
– swisstopo (Federal Office of Topography, Switzerland)
– USGS (U.S. Geological Survey)
– basemap.at (Austria)

3.2 Intellectual Property of Data: Intellectual property rights and copyrights remain entirely with the respective data creators and institutions. The User is strictly prohibited from removing, obscuring, or altering any automatically generated copyright notices, logos, watermarks, or data attribution links displayed within the live App or on exported layouts.

3.3 Data Accuracy Disclaimer: All digital mapping information and terrain layouts are provided strictly on an “as-is” and “as-available” basis, without any warranties of any kind. We explicitly disclaim all warranties, express or implied, regarding the absolute accuracy, completeness, correctness, safety, reliability, or timeliness of the geographic coordinates, elevation models, or boundary representations. Users are solely responsible for verifying critical geographic data in real-world environments.

The generated 3D maps and provided GPX tracks are strictly for visual representation, planning, and design purposes. They must not be used for real-time navigation, life-saving decisions, or in situations where extreme precision is required.

4. Conclusion of Contract

By placing an order or using our services via WooCommerce, you make a binding offer to conclude a contract with us. The contract is concluded when we confirm acceptance (e.g., by email) or provide access to the service.

5. Prices and Payment

All prices are in US-Dollar and include VAT as applicable. Payment methods available are Stripe and credit card. Payment is due immediately upon ordering.

6. Delivery and Digital Content

For digital content, software access keys, and subscriptions, access to the platform will be provided immediately after successful payment via your user account.

7. Right of Withdrawal (Consumers only)

Consumers within the European Union have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day of the conclusion of the contract. To exercise your right of withdrawal, you must inform us by means of a clear declaration (e.g., a letter sent by post or email) of your decision to withdraw from this contract within the withdrawal period.

Consequences of Withdrawal: If you withdraw from this contract, we will reimburse all payments we have received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision. We will carry out such reimbursement using the same means of payment as you used for the initial transaction.

Expiry of the Right of Withdrawal for Digital Content: The right of withdrawal expires prematurely for contracts regarding the delivery of digital content (non-tangible goods) if:
– The execution of the contract has begun (i.e., access to the mapping platform has been granted), AND
– You have expressly consented to the commencement of the execution of the contract before the expiry of the withdrawal period, AND
– You have confirmed your knowledge that by giving this consent, you lose your right of withdrawal.

8. Warranty, Liability, and Voluntary Refunds

8.1 Statutory Warranty: We are liable for material defects and defects of title in accordance with the applicable statutory provisions.

8.2 Limitation of Liability: We are only liable for damages resulting from intent, gross negligence, or breach of essential contractual obligations (cardinal obligations). In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable, typically occurring damage. This limitation does not apply to damages resulting from injury to life, body, or health. Furthermore, we assume no liability for hardware damages, navigational errors, route inaccuracies, or personal injury resulting from the use or reliance on the public and open-source data layers. Furthermore, we assume no liability for software crashes, data loss, temporary server downtimes, navigational errors, route inaccuracies, or personal injury resulting from the use or reliance on the generated maps and open-source data layers.

8.3 Voluntary Refunds for Digital Goods: Outside of the statutory warranty rights, we generally do not offer refunds for “change of mind” or incompatibility issues where system requirements were clearly stated. However, strictly as a voluntary gesture of goodwill, we may offer a refund in specific cases such as:
– Duplicate orders: You accidentally purchased the same product or subscription twice.
– Technical errors: Proven technical defects clearly caused by our system architecture that cannot be resolved.

9. Intellectual Property

All custom application interface content on this website (texts, images, logos, proprietary designs, and UI source code) is protected by copyright and may not be used or reverse-engineered without prior written consent.

10. Data Protection

Our Privacy Policy applies to the use of personal data.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany. If you are a business customer, the exclusive place of jurisdiction is Berlin.

12. Changes to the Terms

We reserve the right to amend these Terms at any time. Changes will be published on this page and apply from the date of publication.
